When making a decision whether recruiting from overseas is the right thing to do you need to consider the following. Which country you should recruit from, which is the right type of visa, what your obligations are as an employer, how to source the employees and what the costs will be. A lot of information is available on the tyoe of visas available to help you with your recruiting needs. Some good specialist recruiters will offer you a free consultation on these services and they can also provide a long list of partners that might attest to their success.  If you are unsure on any points this is a good way to go, as they will be experts with several years experience and may have learned from previous recruitment of the same type of workers what the pros and cons are likely to be.

The H2B Programs was initiated by US Congress in 1991. In 2002, it was wrapped into the Department of Homeland Security’s U.S. Citizenship and Immigrations Service. The H-2B visa category is available to temporary nonagricultural workers who are coming to the United States to perform temporary services or labor. Visas in this category are only available if qualified U.S. workers capable of performing such services are not available. There is a 66,000 per year limit on the number of foreign workers who may receive H-2B status during each USCIS fiscal year (October through September). Several key industries in the U.S. (tourism, landscaping, food production, other service sector positions) rely on H-2B workers to fill vacancies despite employers’ efforts to hire U.S. workers for low-skilled and semi-skilled short-term employment.Under the H-2B program, foreign workers are hired on a seasonal/special event basis and then return to their country of origin when the season/special event is over.

This combination allows Devyne Consulting  to offer our clients the highest quality research available.

What We Do

After identifying your recruiting needs, including job title, experience desired, required licensing, geographic requirements- we provide a list of names of potential candidates for your recruiting needs. We source and identify the names of the hard to find IT professionals, with current contact information. Our name generation services are an extension to your current in-house recruiting efforts and provide  you with the most desired potential candidates. Our research is an extension to your advertising and job fair/college recruiting results---at a fraction of the cost!

Pricing
We charge $35.00 per name, with a 10 name, per project, minimum. We provide initial results and consultation within 48 hours, and will complete the project within 5 business days. We guarantee all names generated, and will replace any name found to have incorrect contact information

 Research Recruiting

Devyne Consulting Group also offers a product called Research Recruiting. This service bridges the gap between traditional recruiting and sourcing. In a Research Recruiting project the client can choose to what level they want the candidate screened before submitting in a final report. Much like a sourcing project a target and location list are created as well as a set of basic interview questions. We can then simply screen the candidates to develop a final report or clients can choose to have Devyne Consulting Group develop the candidate by introducing them to the position. As we locate qualified candidates we will collect their resumes and they are added to the final report. This is a very customizable service and we will make every effort create a program for your specific needs.

Cultural Exchange (Q-1) Visa

The "Q-1" visa is for certain international cultural exchange programs designed to provide practical training and employment, and sharing of the history, culture, and traditions of participants home country in the United States. The training/employment must be approved in advance by the office of the Department of Homeland Security, US Citizenship and Immigration Services (USCIS) on the basis of a petition, Form I-129Q filed by the U.S. sponsor.

The Immigration and Nationality Act (INA) provides two nonimmigrant visa categories for persons to participate in exchange visitor programs in the United States. The "J" visa is for educational and cultural exchange programs designated by the Department of State, Bureau of Consular Affairs, and the "Q" visa is for international cultural exchange programs designated by the U.S. Citizenship and Immigration Services (USCIS).

The "Q" international cultural exchange program is for the purpose of providing practical training and employment, and the sharing of the history, culture, and traditions of the participant's home country in the United States.

"Q" exchange visitors will be paid by their employing sponsor at the same
rate paid to local domestic workers similarly employed.

The "Q" exchange visitor must be at least 18 years old and be able to communicate effectively about the cultural attributes of his or her country. Participants in the "Q" program must have the designated sponsoring organization file Form I-129, Petition for Nonimmigrant Worker, with the U.S. Citizenship and Immigration Services (USCIS).

 H2A Program

To participate in H2A Program, you need to proof agricultural experience because you will only be working in  agriculture. The employer must: provide free housing to all workers who are not reasonably able to return to their residences the same day; provide either three meals a day to each worker or furnish free and convenient cooking and kitchen facilities for workers to prepare their own meals. If meals are provided, then the employer may charge each worker a certain amount per day for the three meals; provide either Worker's Compensation Insurance, or insurance coverage equivalent to Worker's Compensation Insurance, for all workers; provide free transportation between the employer's housing and the worksite for any worker who is provided housing; provide, at no cost to the worker, all tools and supplies necessary to carry out the work, unless it is common practice in the area and occupation for the worker to provide certain items.

The H2A agricultural working visa allows foreign workers entry to the U.S. to work only in agriculture. The H2A visa is not self-petitioned. Employers must apply on behalf of their employees. The employer can be self-employed, a partnership, corporation or agricultural association. An agent may also apply on behalf of the employer.

An agricultural employer who anticipates a shortage of US workers needed to perfom agricultural labor or services of temporary or seasonal nature may file an application requesting temporary allien agricultural labor certification. "Temporary or seasonal nature" means employment performed at certain season of the year. Usually used in relation to the production and/or harvesting of crop, or for a limited time period of less than one year when an employer can show that the need for the alien worker(s) is truly temporary.

When to Apply?

Although emergency applications are possible, the complex multi-stage H-2A process that MAS-H2A handles for employers generally takes 60 days, and there are housing and other program requirements that need to be addressed in advance. Except in emergencies, please contact MAS-H2A at least 120 days - - four months - - prior to the date you need workers to begin work. That gives MAS time to do our best work on your behalf.

  •  Examples of industries and operations which currently use the program to meet some or all of their seasonal labor needs include

    hay, grain, and wheat growers
vegetable, tobacco and other field crop growers
    fruit growers and orchardists
organic and other specialty or boutique agricultural businesses
    nurseries and greenhouse growers
    Christmas tree farms
horse, cattle and other livestock operations if there are seasonal aspects to the business, like foaling or calving.
